WILMINGTON, N.C. (AP) — A New Hanover County commissioner has been arrested for the fourth time since he was elected to the board in 2010.
Wilmington Police said Brian Berger was found unconscious in his car in the middle of the street around 12:45 a.m. Friday. A woman who called 911 said she honked her horn at the car and knocked on the window, but no one responded.
Berger was charged with driving while impaired and possession of controlled substances. Police say Berger had pills in a bottle, but no prescription.
Berger's lawyer Buddy Allard says the pills were legally described, and Berger just had them in a different bottle.
This is Berger's second DWI charge since his 2010 election. He also has been charged twice with domestic violence.
