A 26-year-old Elizabeth City man is facing a charge of second-degree rape.
James Lardell Mullen, of the 200 block of Pritchard Street, allegedly committed the offense on Aug. 4, Pasquotank County District Court records state.
North Carolina law defines second-degree rape as involving a victim who is mentally disabled, mentally incapacitated or physically helpless.
Elizabeth City police arrested Mullen the evening of Sept. 5, after a warrant was issued on Aug. 26.
Mullen’s bond was set at $50,000, secured. Albemarle District Jail officials on Monday said they had no record of Mullen being in custody.
No additional information about the case was available from the Police Department.
Mullen is due in District Court on Sept. 19, court records state.
